These Terms and Conditions govern your use of the Arabian Skys website and the booking and provision of our services. By using our website or booking our services, you confirm that you have read, understood, and agree to comply with and be bound by these Terms and Conditions in their entirety. If you do not agree with any part of these terms, you must not use our website or services.

1. Booking and Payments

  • Booking Confirmation: All bookings must be made through our official website or authorized booking partners. A booking is not confirmed until full payment has been received and you have received a written confirmation from Arabian Skys. Bookings are subject to availability.
  • Payment Terms: Full payment is required at the time of booking to secure your reservation. We accept various payment methods as specified on our website (e.g., major credit cards, online transfers). All prices are quoted in the currency specified on the booking page.
  • Pricing: We reserve the right to change our prices at any time; however, the price confirmed at the time of booking will not be altered.

2. Cancellations and Refunds

This is a critical section to manage customer expectations and business risk.

  • Guest Cancellations:
    • Cancellations made more than 7 days prior to the safari date are eligible for a full refund.
    • Cancellations made 3 to 7 days prior to the safari date will incur a 50% cancellation fee.
    • Cancellations made less than 72 hours (3 days) before the safari date are non-refundable.
  • Arabian Skys Cancellations: In the rare event we must cancel a safari (e.g., due to extreme weather, safety concerns, or unforeseen operational issues), guests will be offered a full refund or the option to rebook for an alternative date. We are not responsible for any incidental costs incurred by the guest as a result of such cancellation (e.g., travel insurance, flights).
  • No-Shows: Failure to arrive at the designated meeting point at the scheduled time will be considered a “No-Show” and will result in the forfeiture of the entire payment without a refund.

3. Guest Responsibilities and Conduct

  • Compliance: Guests must comply with all instructions and safety briefings provided by our guides and staff. This is for your safety and the safety of the group.
  • Authority of Guide: The Guide’s decisions are final regarding the safety and well-being of the group. Failure to follow instructions, or engaging in behavior that risks your safety or the safety of others, may result in the immediate cancellation of your participation without a refund.
  • Damages: Guests are responsible for any damage they cause to our equipment, vehicles, or property due to negligence or willful misconduct.

4. Safety, Health, and Liability

  • Health Requirements: Guests should be in good health and physically capable of participating in the booked activities. It is your responsibility to inform Arabian Skys of any existing medical conditions, allergies, or special needs prior to booking. We reserve the right to decline a booking if we believe the activity poses an unacceptable risk to the guest’s health.
  • Safety: Safety is our paramount priority. All mandatory safety guidelines and the use of provided safety equipment must be followed during the safari.
  • Limitation of Liability: Guests acknowledge that participation in a desert safari involves inherent risks, including but not limited to, changes in weather, accidents, and injuries. Arabian Skys is not liable for any loss, injury, illness, damage, or death arising from participation in our safaris. Guests participate at their own risk. We strongly recommend guests purchase adequate travel insurance.

5. Website Use and Intellectual Property

  • Content Accuracy: The content on our website is for informational and promotional purposes only. While we strive for accuracy, we make no representations or warranties, express or implied, about the accuracy, reliability, or completeness of the information provided.
  • Intellectual Property: All content on our website, including text, images, videos, logos, and code, is the exclusive property of Arabian Skys or our licensors and is protected by international copyright and trademark laws. You may not reproduce, distribute, or use any content without our prior written permission.

6. Privacy

  • Data Collection: We collect and use personal information (such as name, contact details, payment information) in accordance with our separate Privacy Policy. By using our website and services, you consent to our data collection and usage practices as outlined in that policy.
  • Data Security: We implement reasonable and industry-standard measures to protect your personal information from unauthorized access, disclosure, alteration, and destruction.

7. Force Majeure

Arabian Skys shall not be liable for any failure or delay in the performance of our obligations resulting from events beyond our reasonable control, including but not limited to, acts of God (e.g., extreme weather, earthquakes), war, terrorism, government restrictions, or civil unrest. In such events, we will attempt to offer an alternative date or a credit note.

8. Changes to Terms

We reserve the right to update or modify these Terms and Conditions at any time. Any changes will become effective immediately upon being posted on this page with an updated “Effective Date.” Your continued use of our website and services following the posting of the revised terms constitutes your acceptance of the new Terms and Conditions.

9. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of Federal Laws of the UAE.

Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of UAE.
